It all depends on the type of person you need to employ and where they come from

NON-EU NATIONALS

From 1 December 2020, the way non-EU nationals could be sponsored changed. Sponsoring at RQF Level 6 was reduced to RQF Level 3 meaning, you can now sponsor lower grade of skilled workers.


EU NATIONALS

From 1 January 2021, if you wish to employ EU nationals who were not in the UK by this date, to employ such workers, unless exempt, you will have to sponsor them to comply with the new UK immigration rules.

New Points-Based System Overview

UK organisation's are now required to sponsor EU and non-EU nationals under Long-Term and Short-Term visa routes

What is the points-based system?

In 2008, the Home Office successfully introduced an Australian style points-based system (PBS) that streamlined around 80 visa types. PBS allowed non-EU nationals to work and study in the UK where UK sponsors would issue a virtual permit known as a CAS or CoS. In December 2020 the PBS was updated with new rules.

Do I need a sponsor licence?

Up until 31 December 2020 you needed a sponsor licence (SL) to employ non-EU nationals. As from 1 January 2021, you will need one if you wish to sponsor EU nationals. Overseas nationals needing permission to work in the UK will need to be sponsored under the organisation SL sponsorship management system.

Understanding sponsor licence compliance

It is not that straightforward to obtaining a Home Office sponsor licence. Your organisation must have in place a compliant system that complies to the 5 key areas essential to meeting the Home Office guidelines. Failure to have it and maintain it, the sponsor licence is likely to be downgraded or revoked.

Applying for a sponsor licence

Before you can apply for a sponsor licence, are you 100% confident you have a compliant system in place? Is is robust and if the Home Office compliance officers turned up to audit you, would you be confident in passing their inspection? If unsure, you really need to read this section.

Home Office compliance audit

Home Office sponsor licence (SL) audits can be prior to your SL being approved to verify if your organisation is 'fit for purpose' to sponsor overseas workers or, once your SL has been approved, you are likely to be audited by the Home Office compliance officers and visits can be announced or unannounced.

Sponsor licence support

If your sponsor licence (SL) is approved, you must maintain a compliant SL at all times. This is where our expertise comes in. As A regulated immigration law firm, the Home Office will authorise our firm to access your sponsorship management system to help you keep it compliant.

    What is a Health and Care worker via?

    This visa type replaced Tier 2 General on the 1 December 2020 and falls under long-term work visa which is designed for skilled workers and most long-term visa routes lead to UK settlement status.


    To work under this visa route, will need a UK sponsor who are regulated by a healthcare or education provider.


    If a UK sponsor agrees to sponsor you, they will need to assign you a Certificate of Sponsorship which is a virtual work permit required before you can apply for a visa to enter or remain in the UK.

  • International Sportsperson

    What is a Sportsperson visa?

    This visa type replaced Tier 2 Sportsperson on the 1 December 2020 and falls under long-term work visa which is designed for professional sportspeople and this visa route can lead to UK settlement status.

    What is a Minister of Religion visa?

    This visa type replaced Tier 2 Minister of Religion on the 1 December 2020 and falls under long-term work visa which is designed for skilled workers and most long-term visa routes lead to UK settlement status.


    To work under this visa route, you will need a UK sponsor. If a UK sponsor agrees to sponsor you, they will assign you a Certificate of Sponsorship which is required before you can apply for a visa.

  • Senior or Specialist Worker

    What is a Senior or Specialist Worker?

    This visa type replaced the Intra-company Transfer on the 11 April 2022.


    This visa type is designed for senior or specialised skilled workers to come to the UK from the overseas organisation to work in a UK branch.


    The UK organisation will need a sponsor licence and issue a Certificate of Sponsorship.


    The UK sponsor must pay a minimum salary of £42,400 per year, the employee must have been employed by their organisation overseas for at least 12 months.


    The maximum UK visa permission to work in the UK can be up to 5 or 9 years, this will depend on the annual salary.


    Different immigration rules apply to this visa type to the Skilled worker visa route.


    To get sponsored under this route, a link between the UK and overseas businesses must be demonstrated and meet other criteria before assigning a Certificate of Sponsorship.


    This visa route does not allow UK settlement status.

    What is a Skilled worker visa?

    This visa type replaced Tier 2 General on the 1 December 2020 and falls under long-term work visa which is designed for skilled workers and most long-term visa routes lead to UK settlement status.

    What is a Charity worker visa?

    This visa type replaced Tier 5 Charity worker on the 1 December 2020 and falls under short-term work visa which is designed for a overseas national to apply for a field-based unpaid work visa via UK sponsorship.


    To work under this visa route, you will need a UK sponsor. If a UK sponsor agrees to sponsor you, they will assign you a Certificate of Sponsorship which is required before you can apply for a visa.

  • Creative Worker visa

    What is a Creative & Sporting visa?

    This visa type replaced Tier 5 Creative and Sporting on the 1 December 2020 and falls under short-term work visa which is designed for a overseas national to apply for a creative or sporting work visa via UK sponsorship.


    To work under this visa route, you will need a UK sponsor. If a UK sponsor agrees to sponsor you, they will assign you a Certificate of Sponsorship which is required before you can apply for a visa.

  • Government Authorised Exchange visa

    What is a Government Authorised Exchange visa?

    This visa type replaced Tier 5 Government Authorised Exchange on the 1 December 2020 and falls under short-term work visa which is designed for a overseas national wanting to come to the UK for a short time for work experience or to do training, an Overseas Government Language Programme, research or a fellowship through an approved government authorised exchange scheme.


    To work under this visa route, you will need a UK sponsor. If a UK sponsor agrees to sponsor you, they will assign you a Certificate of Sponsorship which is required before you can apply for a visa.

  • Graduate Trainee visa

    What is a Graduate Trainee visa?

    This visa type replaced the Intra-company Graduate Trainee visa in April 2022.


    This visa type is designed for graduate training programme workers to come to the UK from the overseas to work in a UK branch.


    The UK organisation will need a sponsor licence and issue a Certificate of Sponsorship.


    This visa route allows the UK sponsor to bring  overseas employees to the UK under their sponsor licence for a maximum of 5 years in any 6 year period if earning between £42,400 to £73,900.00 per year.


    If the overseas worker annual income is at or above £73,900 then they can be sponsored up to 9 years in any 10 year period.


    Different immigration rules apply to this visa type to Skilled workers.


    To get sponsored under this route, a link between the UK and overseas businesses must be demonstrated and meet other criteria before assigning a Certificate of Sponsorship.


    This visa route does not allow UK settlement status.

  • International Agreement Worker visa

    What is a International Agreement worker visa?

    This visa type replaced Tier 5 Charity worker on the 1 December 2020 and falls under short-term work visa which is designed for a overseas national to apply to do work covered by international law or treaty while in the UK that can cover working for a foreign government, working as a private servant in a diplomatic household or providing a service under contract as a contractual service supplier or independent professional.


    To work under this visa route, you will need a UK sponsor. If a UK sponsor agrees to sponsor you, they will assign you a Certificate of Sponsorship which is required before you can apply for a visa.

  • Religious Worker visa

    What is a Religious worker visa?

    This visa type replaced Tier 5 Religious worker on the 1 December 2020 and falls under short-term work visa which is designed for a overseas national to apply for non-pastoral role or religious order support work.

  • Seasonal Worker visa

    What is a Seasonal worker visa?

    This visa type replaced Tier 5 Seasonal worker on the 1 December 2020 and falls under short-term work visa which is designed for a overseas national to apply for farm work for a visa for 6 months.


    To work under this visa route, you will need a UK sponsor. If a UK sponsor agrees to sponsor you, 

    they will assign you a Certificate of Sponsorship which is required before you can apply for a visa.

  • Secondment Worker visa

    What is a Secondment Worker visa?

    This visa type was first introduced in April 2022 to allow an overseas employer who has a high-value contract with a UK organisation to sponsor a secondment worker to do the contract work.


    Unless the overseas employee has worked for their overseas employer for 12 months, this visa route will not be accepted.


    The UK organisation will need a sponsor licence and issue a Certificate of Sponsorship.


    Different immigration rules apply to this visa type to Skilled workers.


    To get sponsored under this route, a high value contract must be in place. Verbal contracts will not be accepted, and a written contract must clearly outline the B2B agreement in detail to avoid the Home Office challenging the validity between the UK and overseas businesses relationship.


    This visa route does not allow UK settlement status.

  • Service Supplier visa

    What is a Service Supplier visa?

    This visa type was first introduced in April 2022 to allow an overseas business to provide contract work services to a UK organisation by either providing one of their employees or a self-employed individual based overseas and contracted to the overseas business.


    The job in question must eligible but if the job is not eligible you may still qualify if you have relevant qualifications and experience.


    Unless the overseas person has worked for their overseas employer for 12 months, this visa route will not be accepted but if you fall under a self-employed business, have at least 12 months’ professional experience.


    The UK organisation will need a sponsor licence and issue a Certificate of Sponsorship.


    Terms of this visa route is that when providing a service to a UK business under a contract that is covered by a valid international trade agreement.


    This visa route does not allow UK settlement status.

  • Youth Mobility Scheme visa

    What is the Youth Mobility Scheme visa?

    This visa type replaced Tier 5 Youth Mobility Scheme on the 1 December 2020 and falls under short-term work visa which is designed for a overseas national to apply if you have certain certain British Nationality or are from certain countries or territories.


    To work under this visa route, you will need a UK sponsor. If a UK sponsor agrees to sponsor you, they will assign you a Certificate of Sponsorship which is required before you can apply for a visa.
